THE MATTER:

Fraudulent Claim Suits Threaten Company's Business and Brand

A major U.S. insurance carrier was sued for payments on claims involving nine catastrophic injury cases. The company called on Katten Muchin Rosenman LLP to pursue a counter suit against an attorney and a former insurance adjuster who were involved in the claims, to show that the claims were fraudulent. The complex, difficult case, filed in U.S. District Court for the Eastern District of Michigan, involved over 300 separate events related to the nine injury cases.

Dynamic Timeline Helps Katten Show Complex Fraud Scheme

Katten hired CaseSight to design case presentation assets that would simplify this dizzying array of information and effectively show the coordinated and complex nature of the fraud to the Michigan judge and jury.

CaseSight created a powerful, flexible interactive presentation that allowed Katten’s trial attorneys to show events from each of the nine cases separately or simultaneously, in any combination or all at once. CaseSight further tied this presentation to a discrete timeline, enabling the Katten lead attorney to clearly show trends in communication between the defendants in the nine different cases over relevant time periods, which in turn demonstrated the fraudulent nature of the injury case claims.

In addition, CaseSight built into the presentation the ability for Katten’s litigation team members to edit the text of the events, and to add or delete events. This added great flexibility for Katten’s trial team, and eliminated a dependence on CaseSight for last minute changes, helping make Katten’s case development process more efficient and streamlined. CaseSight’s presentation could also be dynamically changed by the attorneys during the presentation for ultimate flexibility.

This interactive and dynamic solution allowed the attorneys to move seamlessly between showing the broad, coordinated trends that indicated the fraud, to the fine details of individual events, which further demonstrated to the jury the fraudulent nature and purpose of the claimants’ actions, and helped seal the verdict.

$4.2 Million Verdict for Major Insurance Carrier

The Katten trial team employed CaseSight’s interactive timeline throughout the six-week jury trial to dramatic effect. The jury returned a $4.2 million verdict against the defendants, in support of the insurance carrier.
